We are so grateful for your willingness to help with MBSEF races and events. Throughout the year we have many needs for help, from office projects to events such as Ski Swap and the PPP, youth development events or alpine and nordic races.  Volunteers help keep our costs down and therefore allow us to invest our money where it matters-quality athletic development and competition programs.  These experiences simply wouldn’t be possible without the dedication and support of volunteers like you. Whether you’re assisting at a race or one of our larger events, your time and effort directly contribute to the success of our programs and the development of our athletes.

Liability Release; Indemnity Agreement
In consideration of the undersigned volunteering to assist with and/or participate in Mt. Bachelor Sports Education Foundation, Inc., an Oregon non-profit corporation (“MBSEF”), programs and events during the 2026-2027 season (the “Activities”) and the use of Mt. Bachelor LLC, an Oregon limited liability company (“Mt. Bachelor”), premises and facilities in connection with the Activities (the “Facilities”), the undersigned volunteer or the parent and/or guardian of the volunteer where volunteer is under age 18 (for himself/herself and his/her respective heirs, next-of-kin, personal representatives, successors and assigns) hereby agrees to release MBSEF and Mt. Bachelor, including their respective shareholders, members, managers, directors, officers, agents, employees, affiliates and volunteers (hereinafter, the “MBSEF Affiliates”) from any and all claims for property damage, injury, death or other losses, which the volunteer may suffer arising out of the Activities or use of the Facilities” This Release shall apply to any claim for property damage, injury, death or other losses, even if caused by the negligence of the MBSEF Affiliates. This release does not release claims based upon gross negligence, reckless, willful or intentional misconduct.

The Activities may include skiing (nordic and alpine), bicycle riding (including downhill lift service riding and enduro style riding), trampoline training and indoor strength training and volunteers assistance with such Activities. The undersigned understands and acknowledges that participation in and/or volunteering to assist with such events is inherently dangerous and represents an extreme test of a person’s physical and mental limits. Volunteer specifically acknowledges that the use of freestyle parks, terrain features or half pipes, and inverted aerials (inverted aerials are attempts to maneuver the human body wile airborne, and can involve maneuvers like flips and somersaults) present increased and significant inherently dangerous risks. The undersigned acknowledges the risks and dangers associated with participation in, and volunteering to assist with, the Activities and use of the Facilities including, but not limited to, potential for serious bodily injury, sickness and disease, permanent disability, paralysis and loss of life, loss of or damage to equipment/property, changing weather conditions, variations and steepness in terrain, terrain features and parks, snow or ice conditions, surface or subsurface conditions, collisions with natural or man-made objects or other persons, equipment failure, temperature, the physical condition of athletes, signage, directions or lack thereof, falling, loss of control, exceeding one’s ability, excessive speed, vehicles and vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, event officials, third parties, event monitors and or producers, hydration or lack thereof and other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”).

ORS 30.970 PROVIDES THAT THE “INHERENT RISKS OF SKIING” INCLUDES, BUT IS NOT LIMITED TO, THOSE DANGERS OR CONDITIONS WHICH ARE AN INTEGRAL PART OF THE SPORT, SUCH AS CHANGING WEATHER CONDITIONS, VARIATIONS OR STEEPNESS IN TERRAIN, SNOW OR ICE CONDITIONS, SURFACE OR SUBSURFACE CONDITIONS, BARE SPOTS, CREEKS AND GULLIES, FOREST GROWTH, ROCKS, STUMPS, LIFT TOWERS AND OTHER STRUCTURES AND THEIR COMPONENTS, COLLISIONS WITH OTHER SKIERS AND A SKIER’S FAILURE TO SKI WITHIN THE SKIER’S ABILITY. ALL SUCH “INHERENT RISKS OF SKIING” ARE INCLUDED AS PART OF THE “RISKS” DEFINED IN THE PRIOR PARAGRAPH. A NOTIFICATION OF SKIIER’S DUTIES REQUIRED BY ORS 30.990 IS SET FORTH BELOW.

The undersigned volunteer or the parent and/or guardian of the volunteer where volunteer is under age 18 (for himself/herself and his/her respective heirs, next-of-kin, personal representatives, successors and assigns) agrees to hold harmless and indemnify the MBSEF Affiliates from any and all claims and liability arising out of or in connection with the volunteer’s participation in, or volunteer work in connection with, the Activities or use of the Facilities, and for any damage to property of or personal injury to any third party, resulting from the volunteer’s participation in, or volunteer work in connection with, the Activities or use of the Facilities.

Express Assumption of Risks
I acknowledge that participation in, or volunteering in connection with, the Activities and use of the Facilities involve inherent risks that may cause serious injury and even death, including, but not limited to, the Risks, which include the “Inherent Risks of Skiing” under ORS 30.970. I fully understand those risks and dangers and accept the same on behalf of the volunteer. If, for any reason, the above Liability Release provision is not effective, the undersigned agrees that the volunteer assumes the inherent risks with the Activities and use of the Facilities. Specifically, in consideration of participation in, or volunteering in connection with, the Activities and use of the Facilities, the undersigned agrees to not make any claim nor bring any suit for any damages, injury or death which the volunteer may suffer as a result of participation in, or volunteering in connection with, the Activities or use of the Facilities wherein one or more of the inherent risks associated with this activity constitutes a substantial factor in causing the damage or harm.

Choice of Law and Venue; Severability
This Release and any rights, duties and obligations as between the parties to this Release shall be governed by and interpreted solely in accordance with the laws in the state of Oregon and no other jurisdiction. Any litigation involving the parties to this Agreement shall be brought solely within Deschutes County, Oregon and shall be within the exclusive jurisdiction of the Courts of Deschutes County. Every provision of this Release is intended to be severable. If a court or agency of competent jurisdiction determines that any provision contained in this Release is illegal, invalid, or unenforceable, such illegality, invalidity, or unenforceability will not affect the other provisions of this Agreement, which will continue in full force and effect.

The undersigned has carefully read and understands this Release and all of its terms, including, but not limited to the “Inherent Risks of Skiing” pursuant to ORS 30.970 and the disclosure of a skier’s duties included with this Release pursuant to ORS 30.990 and 30.985. The undersigned understands that this document is an agreement of release and/or express assumption of risks that will prevent the undersigned and/or the minor participant(s) from recovering damages from the MBSEF Affiliates in the event of property damage, injury, death or other losses. The undersigned, nevertheless, enters into this Release freely and voluntarily and agrees that it is binding upon the undersigned and the heirs, next-of-kin, personal representatives, successors and assigns, and legal representatives of the undersigned. The undersigned further acknowledges that the undersigned has many recreational opportunities available to them and they are voluntarily choosing to participate in, or volunteer in connection with, the Activities and/or use of the Facilities, to enter into this agreement and to release the MBSEF Affiliates from any and all claims for property damage, injury, death or other losses, which the volunteer may suffer arising out of this activity including, but not limited to, those associated with the Risks.

SKIER SAFETY ENFORCEMENT CRITERIA

In the discretion of MBSEF and/or Mt. Bachelor, violation by the undersigned volunteer of the duties of skiers disclosed below pursuant to ORS 30.990 and ORS 30.985, violation of the list of offenses listed below, or any other conduct detrimental to the safety of other skiers or in violation of the United States Association Code of Conduct, or the Code of Conduct of MBSEF may result in the loss of all skiing privileges at the Facilities, and with the loss of all privileges of participation in, or volunteering in connection with, the Activities or loss of volunteer’s lift ticket/season pass without refund.

PARENTAL/GUARDIAN CONSENT FOR MINORS

The undersigned hereby certifies that s/he is the parent or legal guardian of the minor(s) identified below. In consideration of the minor(s) listed below being permitted to participate in, and/or volunteer in connection with, the Activities and use of the Facilities, I execute this “Parental/Guardian Consent for Minors” to agree to the terms of the foregoing “Liability Release/Express Assumption of Risks Agreement” on behalf of the minor(s) identified below. Further, I agree to the following waiver, release & indemnification acknowledging all the risks and hazards listed in the general “Liability Release/Express Assumption of Risks Agreement”.

The undersigned parent or legal guardian of the minor(s) listed below, for himself/herself & on behalf of said minor, hereby joins in the foregoing Liability Release/Express Assumption of Risks Agreement and hereby stipulates and agrees to save and hold harmless, indemnify, and forever defend the MBSEF Affiliates from any claims, actions, demands, expenses, liabilities of said minor and further agrees not to sue any of the MBSEF Affiliates as a result of any injury, paralysis, or death that said minor(s) suffers in connection with his/her participation in the Activities or use of the Facilities.

ATTENTION SKIERS/SNOWBOARDER/SNOWRIDERS

YOUR DUTIES


ORS 30.990 REQUIRES USE TO NOTIFY SKIERS OF THEIR DUTIES PURSUANT TO ORS 30.985. THE LAW IMPOSES THE FLLOWING DUTIES ON ALL SKIERS REGARDLESS OF WHAT TYPE OF EQUIPMENT THEY USE. VIOLATION OF ANY OF THE FOLLOWING DUTIES ENTITILES MT. BACHELOR AND/OR MBSEF TO WITHDRAW THE VIOLATOR’S PRIVILAGE OF SKIING.

(a) Skiers who ski in any area not designated for skiing within the permit area, assume the inherent risks thereof.
(b) Skiers shall be the sole judges of the limits of their skills and the ability to meet and overcome the inherent risks of skiing and shall maintain reasonable control of speed and course.
(c) Skiers shall abide by the directions and instructions of the ski area operator.
(d) Skiers shall familiarize themselves with posted information on locations and degree of difficulty of trails and slopes to the extent reasonably possible before skiing on any slope or trail.
(e) Skiers shall not cross the uphill track of any surface lift except at the points clearly designated by the ski area operator.
(f) Skiers shall not overtake any other skier except in such a manner as to avoid contact and shall grant the right of way to the other skier.
(g) Skiers shall yield to other skiers when entering a trail or starting downhill.
(h) Skiers must wear retention straps or other devices to prevent runaway skis and snowboards.
(i) Skiers shall not board rope tows, wire rope tows, J-bars, T-bars, ski lifts or other similar devices unless they have sufficient ability to use the devices, and skiers shall follow any written or verbal instructions that are given regarding the device. Skiers shall request instructions if unfamiliar with any ski lift device before boarding it.
(j) Skiers, when injured in a skiing accident, shall not depart from the ski area without leaving their names and addresses if reasonably possible.
(k) A skier who is injured should, if reasonably possible, give notice of the injury to the ski area operator before leaving the ski area.
(l) Skiers shall not embark or disembark from a ski lift except at designated areas or by the authority of the ski area operator.
(m) Violation of any of the duties of skiers set forth herein entitles the ski area operator to withdraw the violator’s privilege of skiing.
